HELPING YOU DETERMINE OR DISPUTE PATERNITY
The purpose of a paternity suit is to determine the identity of the legal father over any given child or children. Once fatherhood is established, the parties may then work together to establish a proper parenting plan and time sharing schedule that takes into consideration the interests of everyone - especially the children.
•· For those men who are asserting their paternal rights and wish to participate actively in the lives of their child(ren), attorney Hughes can help you with proper representation in paternity actions, whether you know if you are the father or not.
•· For those women who are seeking the determination of paternity in an effort to obtain support from the father for their child(ren), attorney Hughes can help you with aggressive representation that will protect your special interest.
Generally, paternity can be established three different ways. First, If your name appears on the birth certificate - there is a presumption given that you are the father, but that presumption is rebuttable. Secondly, pursuant to Section 742, Florida Statutes, you and the mother of the child may sign an admission of paternity - which is just a way to say that you both agree and admit that you are the father. Lastly, the DNA of the putative father and minor child(ren) can be determined by scientific testing, for a fee, with the results known usually in as little as 7 days.
Attorney Hughes frequently recommends that clients participate in DNA testing. It will clearly establish or refute paternity and give you piece of mind.
